Terms of Service

By commissioning me, you acknowledge that you have read and understood these rules.
This is non-negotiable, and I will not be liable should the commissioner choose not to read, misunderstand, or forget the rules listed below. It is up to the commissioner to understand and be aware of the terms listed below.

General

  • Clear visual references are a must.
    If you do not have an existing clear image of your character, you must be willing to pay for a character design commission instead.

  • I can only offer art in my own style with a few variations.
    The art will match the given reference as closely as possible with minor variations due to style difference.

  • I only take payment through Paypal or Ko-fi.

  • All prices shown are base prices, serving as a general guidelines and may or may not increase depending on the character's complexity. My pricing is intuitive; feel free to ask if unsure.

  • I hold the right to refuse any commission should I not be comfortable with or feel I may not be able to do it justice.

Process and payment

  1. Contact me through either Discord, Twitter, Bluesky, or Toyhouse to inquire about commissions.
    These sites are the ones I currently check the most often.

  2. Please provide references of the character(s), pose or scenario if applicable.
    - If possible, please provide a link to a private gallery or folder with organized references to make sorting easier. (such as a deviantArt sta.sh folder, imgur gallery, google drive folder, etc.)
    - Notes and text is also welcome.

  3. I will require payment upfront.
    Once I feel I have the necessary information and references, I'll be asking for the client's email to send the invoice needed for payment.
    Only after receiving payment will I start on the commission.

  4. A rough sketch will be sent to the client for feedback.
    - As feeback is provided, I will make the appropriate changes and fixes until the client is satisfied with the rough sketch.
    - I will only make any major changes up to three times before the client will be required to pay a fee for the extensive work.

  5. Only when the client is satisfied with the rough sketch is when I will start finalizing the piece.
    - Do note that once the client approves of the rough sketch, I will not make any major changes without extra payment.

  6. I will check in with the client after the lineart, and after flat colors to make sure everything is in order before finishing the piece.

  7. Once done, the client will be provided with a DeviantArt Sta.sh link to access the full piece along with variations.
    - The variations may include: a signed version, an unsigned version, a transparent version, a version without extra effects.

Refunds

  • The client may only receive a full refund if I have not started sketching yet.

  • Once the client has approved of the sketch, there will be no refunds.

  • If the client requests a refund during the sketch phase, the work will be cancelled and only half may be refunded to make up for the work already done and for wasting my time and energy.

Liscensing and useage

Unless discussed and paid for, all my commissioned work goes under a "Non-Commercial" license meaning the client may not reproduce or use the commissioned piece to earn money with.

Personal use

  • The client may only use the unsigned version for personal use such as avatars, banners, printing for personal use etc.
    - Under no circumstances are they to repost or reupload the unsigned piece.

  • The client may only share, reupload, or repost the signed version of their commission.
    - This is to prevent art theft, making it easier for people to find me, as well as upholding my rights as the creator to said piece.

Licensing

Commercial work will have commercial prices depending on what the client needs.
This can include, but not limited to, Youtube, Twitch, blogs and similar, used to advertise and/or represent an online personality or company with the intent of selling or earning money from it.
Examples of commercial work may include, but is not limited to: Twitch and Youtube banners and avatars, art for merchandise, brand mascot designs, art which will be used for content or one's channel for V-tubers or content creators.

Simple License

  • AKA. Creative Commons Attribution NoDerivs is a more restrictive license. It allows you to redistribute the material commercially or non-commercially but the user cannot make any changes whatsoever to the original. (source)

  • This will increase the price of the commission by 90% of the original price, with a minimum of an extra 35$.

Advanced License

  • AKA. Creative Commons Attribution ShareAlike which allows the user to distribute, remix, tweak, and build upon the original, so long as the original creator is given credit, or attribution. (source)

  • This will increase the price of the commission by 5x the original price.

Content creator and Vtuber specific commissions

While Content creators and Vtubers sometimes have characters and mascots used to promote a brand and/or channel, I recognize that not all art commissioned will be used to promote said brand, or directly used for content to earn viewership or money.
Below you can see where I draw the line as to what I consider commercial use and personal use.

* "Channel" refers to the designated site the user streams and/or posts content through such as twitch or youtube.

  • Assets made for text- and clip-based sites such as X/Twitter, Bluesky, TikTok, or similar are exempt from this rule and are seen as personal use.

  • If TikTok is the primary site used to stream and earn revenue through, then this does not apply.


Do note that the user is permitted to show off any personal commission as long as it is not directly used as an asset to enhance one's stream.
